Terms of Service
Please read the following Terms of Service carefully, as all members are required to agree to them when signing up for an account. They may be subject to change at any time. Any changes will take effect immediately, and all members may be notified by email that changes to the Terms of Service have been made. For the purpose of this document, Trafficsuperhighway.com shall mean the owners, administrators and staff of this website.
Provision of Service
The service is provided on an "as is" basis. Trafficsuperhighway.com will not be liable for any problems such as loss of data or profits associated with using the service, and may withdraw the service at any time. Your use of this service is at your own risk.
Member Accounts
1. Only one account is permitted per individual or computer. If you are found to have more than one account, all of your accounts may be terminated, with the loss of any credits and referrals.
2. You are required to provide a valid email address when signing up for an account, and that email address must not point to an automated response service. It is your responsibility to ensure your email address is updated if necessary. Members who submit invalid email addresses will be deleted immediately and obviously without warning.
3. As an account holder, you agree to accept email from Trafficsuperhighway.com providing details of updates to the site or service, contests or special offers that may run from time to time, and any other information that Trafficsuperhighway.com administration considers may be of interest to members.
4. Should you wish to cancel your account, you may do so through the link in the members area. Cancellation will automatically result in the loss of all credits and referrals on the account. If you are an upgraded member at the time of cancellation, it is your responsibility to cancel your subscription payment. If any subscription payments are made after cancellation of your account, Trafficsuperhighway.com cannot be held responsible to refund them.
5. If you hold an upgraded account, and your monthly subscription payment is not made, or is made late, your account will revert to free status until payment is made.
6. You are not permitted to enroll other members. If you wish to refer new members, you may do so by directing them to your referral link, and inviting them to enroll themselves. If you are found to have enrolled another member for the purpose of gaining credits or money, your account, and any accounts you have enrolled, may be terminated, with the loss of any credits and referrals.
7. You are not permitted to offer financial incentives to gain referrals. If you are found to have offered a financial incentive for the purpose of gaining referrals, your account may be terminated, with the loss of any credits and referrals.
8. You must be at least 18 years of age due to the adult material which may be promoted on this site at the discretion of the administration.
9. The TrafficSuperHighway no longer will accept sign-ups from Pakistan or India. (effective March 2011)
Websites, Banners and Hotlinks in Rotation
1. At Trafficsuperhighway.com, our aim is to provide you with the best advertising service we can, and with that aim in mind, we try not to restrict too much the content of sites that can be shown in the rotator. If your site content is legal and basically not obscene pornography, or something simular to late night TV, then it will probably be approved. Here is a list of site content that will not be approved:
* Warez
* Hate sites
* Pornographic websites (sexual acts, excessive nudity)
* Non-english sites
* Sites containing Adsense ads (not permitted by Google)
* Sites that have more than one pop-up or break frames
* Sites that freeze the surf bar or contain viruses
* Sites that contain script downloads
If your site disrupts the surfing process in any way, it will not be approved. This may include the use of rotator sites or banners.
2. Trafficsuperhighway.com will make every attempt to ensure that all sites in rotation conform to the conditions stated in these terms. However, Trafficsuperhighway.com and/or its staff will not be held liable for any site appearing in the rotator that does not conform. If you find such a site while surfing, please report it using the link in the surf bar.
3. Trafficsuperhighway.com will not be liable for any income claims made by sites that are placed in rotation.
4. NOTE: New Policy effective March 2011. Due to liberal sign-up offers it has come to the attention of the administration that certain members are attempting to manipulating the system and creating what appears to be duplicate accounts. The administration will monitor this activity and eliminate this practice to the best of our ability using tools within the script and by scrutinizing sign-up information submitted, websites submitted for rotation, and any other information we may gather. This may include information such as country of origin, suspicious email addresses which appear to be created in multiple fashion, similar passwords and so forth. The intent of this policy is to eliminate massive submissions of the same website(s) which appear to be promoted (for whatever reason, perhaps a subversive organization using this median to communicate secret messages… who knows) by perhaps the same person or group of persons. Websites which are submitted continuously by one or more “members” will NOT be approved for rotation on this traffic exchange. The administration of this traffic exchange does not wish to block all members from any particular country, however we will monitor this activity and take corrective measures if the statistics show a major source of said activities.
Use of the Surf Bar
Trafficsuperhighway.com is a manual traffic exchange designed with user participation in mind. Using multiple browser windows to surf, or any other programs that are designed to automate the surfing process are not permitted. If you are found to be using such a program or technique, your account will be terminated with the loss of all credits and referrals.
Promoting Trafficsuperhighway.com
You are permitted to use any legal and ethical means to promote the Trafficsuperhighway.com service, including, but not limited to, placing your affiliate site or links to it on other traffic exchange services, forums and other websites, where permitted. You may not use unsolicited commercial email or spam to promote your affiliate site. If you are found to have done this, your account will be terminated with the loss of all credits and referrals.
Transfer of Credits
Credits may not be transferred between members and their referrals. Credits may not be sold, or given in exchange for any other product or service.
Commission / Prize Payments
Commission or prize payments are made on or before the 15th of the month for all monies earned in the previous month, providing the account balance exceeds or is equal to $7. Payments are made to PayPal or AlertPay accounts only. You must have an account, or payment will not be made, and forfeited as accrued each month. Balances may or may not be carried forward at the sole discretion of the administrators. We will make every effort to pay commissions or cash contest winnings on time to either payment processor you request. However, we cannot be held responsible for delays caused by processor site maintenance or downtime, errors in the information you have provided, or any other event that is beyond our control. If a transaction fee is required for us to pay you, the entire fee will be deducted from your payment. Members must meet all terms and conditions listed herein.
Effective as of October 4th, 2011 - The weekly DRIVE 4 CASH contest will be cancelled on any given week unless at least 7 members qualify.
Effective as of August 1st, 2011 - All members are now eligible for cash prize payments. The weekly DRIVE 4 CASH contest is open to all members. Be advised: The TrafficSuperHighway is not a PTC website.
Please note that effective January the 1st, 2012 the TrafficSuperHighway will now pay a 50% referral commission for Platinum upgrades. Currently the yearly cost of a Platinum upgrade is $50, so the referral fee is $25. Not too shabby!
Refunds
All sales of upgraded accounts and credits are final, and no refunds will be given. This includes advertising options on the site.
NEW BENEFITS FOR PLATINUM STATUS MEMBERS EFFECTIVE 01-01-2012
All members who upgrade to Platinum status (or renew existing subscriptions after the 1st of January 2012) will automatically receive a gift from the TrafficSuperHighway Platinum Members Investment Fund. (TSHPMIF) The administration will allocate ten percent of the upgrade fee into the TSHPMIF. Once each year dividends will be paid as a gift to Platinum status members. The TrafficSuperHighway administration will invest the money in a selected HYIP to create a profit. The TSHPMIF hypothetically is a highly leveraged investment fund with a compounding feature. Although no investment can be guaranteed, members will most likely benefit from this investment. This fund is essentially, for all legal reasons, a gift from the TrafficSuperHighway. There will be no official statement of accounts issued, no legal paperwork is required, and members have no legal right to any fund or account(s) held by the administrator. Upgraded Platinum members are held in very high regard here at the TrafficSuperHighway and the administration considers it a privilege to undertake this endeavor. Please see legal statement posted below.
LEGAL STATEMENT
If required, this entire statement, or parts thereof will be modified to conform to existing law, whereby any legal ramifications will be muted. In other words, or layman’s terms, we will not be liable to the IRS or any other governmental agency or jurisdiction for taxes owed, registration, or fees of any kind whatsoever. Any agent or representative of a legal tax enforcement division, either federal, state, county, municipality or entity should be aware that the entire concept of this provision of the ‘Membership Agreement’ is to be construed as my right as an individual (operating as the administrator of this traffic exchange) to give my Platinum upgraded members a gift each and every year they remain a Platinum status member of this traffic exchange.
DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITIES, INDEMNIFICATION
Trafficsuperhighway.com does not warrant that the website and service will be error free or uninterrupted. The website and service is provided on an "as is" basis without warranties of any kind, either expressed or implied.
Trafficsuperhighway.com will not be responsible for any losses, damages or costs that you and/or your business may suffer when using the website or service. You agree to indemnify and hold harmless Trafficsuperhighway.com from any claims resulting from your use of the website or service.
You expressly agree that use of the website or service is at your sole risk. Neither Trafficsuperhighway.com nor its service providers, agents, licensors or employees shall have any liability for any damages suffered by you or any other party as a results of the use or misuse of the service.
COPYRIGHT
All content included on this site, such as text, graphics, logos, button icons, images, audio clips and software, is the property of Trafficsuperhighway.com or its content suppliers and protected by international copyright laws. No part of this website may be reproduced or transmitted in any form or by any means without written permission from the authors.
Agreement Statement - Continuation
As a Member of TrafficSuperHighway.com I request that the administrator does not give out any of my submitted personal information for any reason.
I also understand that in order for me to receive my bonus and/or join credits and/or to fully activate my account I must surf the required number of sites, currently set at 1. If I do not fully activate my membership within 14 days I may not be interested in remaining with the site and understand that you may remove me from the site without further notice.
I hereby state that I will not put any excessively obscene pornographic websites, illegal or objectionable in nature on the exchange be it via surf site, hotlink or banner. If in doubt of the acceptability of a site I will contact the Administrator prior to setting it up. I also understand that doing so may result in my membership on TrafficSuperHighway.com to be terminated without warning which will result in the loss of any and all credits and / or cash earnings I may have accumulated.
I understand that the Exchange may or may not accept rotator sites at its own discretion. Because they are beyond my control I further understand that if I choose to use a rotator site and something on it breaks frames I will likely lose my account and any earnings I may have accumulated. I also understand that the speed of all Traffic Sites can be affected by the number of sites in the database.
Should my account show a negative balance or no activity for a period of more than 3 months, the administrators will assume I have abandoned my account and may close my account, ban my IP address, or remove credits at the discretion of the administration. Inactive member accounts may also forfeit their free upgrade at the discretion of the administration. Monthly credits will not accumulate on inactive accounts, regardless of membership level.
I agree that I will only email my direct referrals once per week and that I will never send material that may be offensive to them. If I do, then you are welcome to remove my account.
EXCESSIVE SURFING
In order to maintain a stable traffic exchange the practice of excessive surfing is prohibited. Members who exceed 500 clicks per day will not accumulate additional credits or be eligible for prizes. (The Administration may adjust credits) and may be subjected to becoming inactive for up to 72 hours, or upon repeated disregard for this policy, be removed as a member altogether. This traffic exchange is not a large traffic exchange and as such must protect the vast majority of members from having credits used up by one or more members surfing excessively. The threshold of 500 credits may be changed as conditions warrant at the discretion and judgment of the administration.
INACTIVITY
The TrafficSuperHighway is committed to providing a valuable service to the membership. While we try to provide superior benefits such as extremely generous ratios, quick timers, and various methods for members to acquire bonus credits, it has come to the attention of the administration that many members simply sign up to take advantage of our liberal sign-up campaigns.
In order to counter-act this abusive behavior of certain members we are forced to impose yet another policy. Effective as of April 1, 2010 new members who receive sign-up offers such as credits, upgrades, or other such sign-up incentives are subject to the loss of said incentives if after 30 days the member is deemed to be “inactive” by the administration. This may also effect membership status at the discretion of the administration. Although this may be simply a judgment of the administrator, members are free to dispute these decisions and state their case to reverse the ruling.
Member accounts with unused credits (no websites in rotation) may also be deemed as "inactive" and be subject to corrective measures after a reasonable time period. This "time period" will be determined by the administration and is not subject to dispute or appeal. We want our members to remain active for obvious reasons and will take proactive steps to achieve this result. Inactive members are not welcome at the TrafficSuperHighway. Please do not join if you are a "tire-kicker".

SPAM
Any advertising (or suspected advertising) of your referral url using spam will result in your membership being removed without notice. This includes the practice known as "spamvertising". Spamvertising is the act of sending out spam to advertise your sites and/or your members referral url regardless of where you send it from. Spamming is illegal.
ADMINISTRATIVE RIGHTS
The Administration reserves the right to change this traffic exchange in numerous ways. One such example of a structural change could be the existing surfing ratio(s). Another such example could be the referral commission rate (currently set at 60%). Be advised that although no plans exist at this time to change anything we reserve the right to do so at anytime.
MEMBER ACKNOWLEDGEMENT
It is the members responsibility to check out these terms from time to time as they may change without notification.
